1. The Defendant’s KRW 4,965,940 as well as the Plaintiff’s annual rate from February 6, 2014 to December 9, 2014, and the following.
1. Basic facts
A. On April 15, 2011, Korea-Japan Construction Co., Ltd. (hereinafter “Korea-Japan Construction Co., Ltd.”) concluded a contract for construction works between the construction cost of the instant construction works with respect to the installation of the machinery and equipment (hereinafter “instant construction”) among the new construction works, between Korea-Japan Construction Co., Ltd. (hereinafter “static machinery and equipment”) and the construction cost (hereinafter “instant construction works”) from April 15, 201 to November 30, 201 (hereinafter “instant construction contract”).
B. On April 30, 2012, the Defendant entered into a payment guarantee contract for the instant construction project with the warranty amount of KRW 354,412,230, and the subcontract consideration payment guarantee contract with the warranty period from April 15, 201 to November 30, 2012 (hereinafter “instant guarantee contract”).
C. On November 23, 2012, Hanil Construction and static Machinery and Equipment agreed to amend the contract to extend the period of the instant construction by June 21, 2013.
The fixed machinery and equipment were paid in cash as listed below by demanding construction from Korea Construction in relation to the instant construction work.
