Basic Facts
The plaintiff is a clan consisting of descendants who jointly set up H 17th HC I, and the defendants are children of the deceased J (Death on February 6, 1997, hereinafter "the deceased").
On October 2, 1971, the registration of ownership transfer was completed on January 1, 1959 with respect to each one-third share of the real estate listed in the separate sheet (hereinafter “each land of this case”) with the deceased and H T T T T T T T T T T T T T T T T T 32, and H H T T 29.
On November 21, 2017, M, the heir of the deceased K, completed the registration of ownership transfer due to inheritance by consultation and division on August 25, 192 with respect to each of the instant parcels of land on August 21, 2017, and thereafter completed the registration of ownership transfer on May 14, 2018 with respect to each of the said shares of 1/3 shares on May 27, 2018.
L on January 9, 2018, with respect to each of the instant lands, the registration of ownership transfer was completed on December 12, 2017 for each of the instant lands on the ground that the title trust was completed on December 12, 2017.
On March 22, 2018, the Defendants completed the registration of ownership transfer based on inheritance by consultation and division on February 6, 1997 as to shares 1/18 (i.e., shares 1/3 x inheritance shares 1/6) from each of the instant lands (i.e., shares registered in the future of the Deceased). The Defendants filed the instant lawsuit on March 26, 2018.
[Ground of recognition] In the absence of dispute, Gap evidence Nos. 1 through 16, Eul evidence Nos. 1 and 2 (if there are serial numbers, each number is included), and the defendants' defense prior to the merits of the whole purport of the pleading, asserted that the plaintiff, prior to the judgment of the court as to the defense prior to the merits of the lawsuit, held a title trust with the deceased, one-third of each of the lands of this case, and sought the execution of the procedure for ownership transfer registration based on the termination of the title trust against the defendants who are their successors, the defendants asserted that the lawsuit of this case raised by N elected at the general meeting of the plaintiff who suffered substantive defects is unlawful.
