1. The Defendant shall pay to the Plaintiff KRW 112,409,748 and the interest rate of KRW 15% per annum from June 25, 2016 to the date of full payment.
Comprehensively taking account of the purport of each statement in Gap evidence Nos. 1 through 6 (including branch numbers, if any), the plaintiff entered into a contract with the defendant for the construction cost of KRW 236,500,000 with the defendant on February 25, 2016 to install the plaintiff; according to the above contract, the plaintiff entered into a contract with the defendant for the construction of a new factory; the amount of progress payment of KRW 25,394,18; and the amount of progress payment of KRW 87,015,561 in the aggregate of KRW 112,409,748 in the amount of KRW 236,50 on April 25, 2016.
Therefore, the defendant is obligated to pay to the plaintiff 12,409,748 won for the progress payment under the construction contract and damages for delay calculated at the rate of 15% per annum from June 25, 2016 to the day of complete payment, as the plaintiff seeks, from June 25, 2016 to the day of complete payment.
