1. The Defendant: (a) KRW 28,936,215 to Plaintiff M and KRW 5% per annum from January 16, 2013 to May 15, 2013; and (b) to Plaintiff M.
1. Basic facts
A. The Plaintiffs worked for the Defendant Company engaging in the production and sales business of coalless coal, etc., and retired on January 1, 2013.
B. Pursuant to Article 20 of the collective agreement concluded with the Taecheon Mining Trade Union (hereinafter “Trade Union”), the Defendant calculated ordinary wages on the basis of basic pay, mine entry allowance, work allowance, company house allowance, work promotion allowance, and heavy food allowance, and paid extension allowance, night allowance, holiday allowance, holiday allowance, annual monthly allowance, etc. (hereinafter “instant statutory allowance”).
C. The part related to the instant case in a collective agreement concluded between the Defendant and the Trade Union (hereinafter “instant collective agreement”) is as follows.
Article 25 (Reward)
1. The Company shall pay bonuses at 400 per annum’s total monthly wages and shall be limited to those who are in office as of the end of each quarter of payment of bonuses.
2. The date of March 31 of the members of the company who were employed on or before January 1 of the quarter of 1/4: April 30, 100% of the members of the company who were employed on or before April 1 of the second quarter of 2/4: June 30: 100% of the members of the company who were employed on or before July 1 of the third quarter of 3/4: October 31, 100% of the members of the company who were employed on or before October 31 of 4/10: 4/100 of the members of the company who were employed on or before December 31 of 4 quarter of 10: 10% of the members of the company paid on or before December 31 of 31.
3. Persons who have sustained a long-term injury for at least three months during the relevant period shall be excluded from the payment of bonuses.
4. Official duties, leave of absence, etc. during a quarter shall be paid in proportion to the number of months of the relevant employment.
Article 40 (Welfare Expenses)
1. The Company shall pay welfare expenses to its members as follows:
Labor Section Subsidies: 280,000 won
(b) Leave expenses: 280,000 won.
(c) Estimated subsidies: 280,000 won;
(d) Kim head subsidies: 280,000 won;
(e) Gu subsidies: 280,000 won;
(f) Special welfare expenses: 700,000 won;
(g) Annual prize money: 300,000 won; and
2. Persons eligible for payment:
(a) Labor-saving subsidies: on May 1;
(b) Vacation leave expenses: The standard on June 30.
(c) Estimated subsidies: Standards for memorials;
(d) Kim President subsidies: As of October 31;
(e) Gu subsidies: Gu administration standards;
(f) Special welfare expenses: As of April 9;
