A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Punishment of the crime
[2014 Highest 2435] The Defendant did not deal with psychotropic drugs-related Megapists (one philophone, hereinafter referred to as "philophones"), but purchased philophones as follows.
1. On August 10, 2013, the Defendant transferred 600,000 won to C in the name of the NongHycheon-dong’s name (Account Number: E) for the purchase of phiphones, and around that time, purchased phiphones by means of receiving the handphones containing 0.7ggopon, which the said C disguisedd with ordinary cargo, from the Gwangju Macheon-dong, and from the Gwangju Macheon-dong bus terminal, the Defendant purchased phiphones by means of receiving the handphones containing 0.7ggopon.
2. On August 27, 2013, at around 17:35, the Defendant transferred KRW 300,000 to the Agricultural Cooperative Account (Account Number: E) in the name of D’s use as the purchase price of phiphones, and around that time, purchased phiphones by means of receiving the handphones containing 0.35gg of the philophone, which the said C disguisedd with general cargo, from the Gwangju Mine-dong bus terminal in Seo-gu, Seo-gu, Gwangju.
[2014 Highest 3280] No person may smoke or take in marijuana or its seeds, but the Defendant smoked marijuana as follows:
1. On December 1, 2010, around 03:00, the Defendant smoked marijuana by inserting approximately 0.5g of marijuana in the pipe that was parked in GPP parking lot located in Seocho-gu Seoul Metropolitan Government F, along with H and I, into the pipe that was made by a gambling place, and attaching a fire to a stop.
2. On December 2010, the Defendant smoked with approximately 0.5g of marijuana, together with H and I, in the same place as at the beginning point 02:00, supra, in the same manner as at the preceding paragraph.
3. On December 2010, the Defendant smoked with approximately 0.5g of marijuana, together with H and I, in the same place as at the beginning of 03:00, supra, in the same manner as at the preceding paragraph.
