All appeals by the defendant are dismissed.
Expenses for appeal shall be borne by the defendant.
Purport of claim and appeal
purport.
1. The reasoning of the court of first instance for the acceptance of the judgment is as follows: “The appraiser’s appraisal result shall be respected as long as there is no obvious error in the appraisal method, etc. that is contrary to the empirical rule or unreasonable (see, e.g., Supreme Court Decision 2004Da70420, 70437, Feb. 22, 2007). At the time of appraisal, the error in the operation of the passenger car of this case was confirmed at the time of appraisal, and the plaintiffs operated the passenger car of this case, the defect in operation was confirmed, and the appraiser failed to operate the passenger car of this case, and the above defect in operation can not be presumed as being recognized. It is difficult to see that there is a reasonable or unreasonable appraisal by the empirical rule of the Civil Procedure Act other than the reason or opinion that the implementation of the program is suspended by an external change of the electronic control system of this case.”
2. The judgment of the court of first instance is justifiable, and all of the defendant's appeals are dismissed. It is so decided as per Disposition.
