1. Defendant A shall be punished by imprisonment for a year and six months, by imprisonment for a year and by imprisonment for a year, and by imprisonment for a year and six months, respectively.
Punishment of the crime
Defendants, along with N andO (a disposition of suspension of indictment on December 9, 2016), operate an unauthorized game room without trade name on the first floor of P and the first floor of Busan P, and Defendant A conspiredd to play a role in attracting funds necessary for the opening of the above game room business, Defendant B and Defendant C invested funds necessary for the opening of the above game room business, Defendant D’s role in attracting customers to the above game room, Defendant D’s role in attracting customers to the above game room, N’s president as so-called president, and role in guiding customers as the head of the above game room when the above game hall was controlled, and the role in guiding customers as the head of the above game room outside the game room, Defendant E andO as an employee; and Defendant E andO conspired to exchange points obtained in the game in the above game room.
No one shall provide for the distribution or use, or display or keep for such purposes, a game product which has not been rated, and no one shall exchange, exchange, arrange for exchange or repurchase the intangible results obtained through the use of a game product for a business.
Nevertheless, from the beginning of November 2013 to the end of December 21:30 of the same year, the Defendants, along with N and N, installed 20 game machine for the “Yemamato” game, which is a speculative machine, the rating classification of which is refused because they fall under the above game site, and exchanged the amount calculated by deducting 10% of commission from the amount calculated by the rate of 5,000 won per point obtained by customers.
As a result, the Defendants provided game water in collusion with N orO for use, and conducted a business of exchanging the results obtained through the use of game water.
