The prosecution of this case is dismissed.
1. On September 9, 2018, the Defendant: (a) around 00:40 on September 9, 2018, the facts charged, on the ground that the victim D (the age of 24) around the Gyeonggi-si B apartment Cdong said that the Defendant and the Defendant’s daily activities read “Isker humbly humb.” and (b) tried to brue the victim with her hand on two occasions; and (c) assaulted the victim, i.e., flabing the fat of the victim by hand.
2. The facts charged in the instant case are those falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act.
On May 24, 2019, after the prosecution of this case, the victim withdrawn his wish to punish the defendant in this court. Thus, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 6 of the Criminal Procedure Act.
