1. Of the judgment of the court of first instance, the part against the defendant exceeding the following amount ordered to be paid shall be revoked, and

Reasons

1. Basic facts

A. The Plaintiff is a juristic person prescribed in Article 3(2) of the Housing Lease Protection Act, which provides a housing owner with a lease fund provided by the government for the stabilization of housing for socially vulnerable people, such as recipients of basic livelihood security, and operates a business supporting rental housing to the occupants selected by a local government. The Defendant is the owner of the real estate indicated in the attached list (hereinafter “instant real estate”).

B. The Plaintiff: (a) on November 5, 2013, the Defendant: Provided, however, the Defendant’s father C represented the Defendant for all of the duties under the instant lease agreement, in order to determine B as a person eligible for support for the lease business; and (b) to establish housing units.

B With respect to the instant real estate, the lessee entered into a lease agreement with the Plaintiff, the lessor, and the occupant as follows (hereinafter “the lease agreement of this case”).

On November 19, 2013, the fifth day of each month of the monthly rent of 20,750,000 won (20,750,000 won) from November 5, 2013, the term of payment for the amount classified under Article 1 (Period and Method of Payment for Lease Deposit) shall be 25,000,000 won, and the deposit for lease on a deposit basis for the instant real estate shall be paid as follows:

(2) 4,250,00 won out of the deposit for lease on a deposit basis under paragraph (1) shall be paid by an occupant who is a person eligible for support for the lease on a deposit basis, and where a contract is terminated due to a failure to pay it to the lessor by the said

(3) The monthly rent of 250,000 won shall be paid directly by the occupant to the lessor each month.

Article 1-2 (Duty to Notify Lessee) (1) Where a tenant fails to pay a monthly rent referred to in Article 1 (3) for at least three months, the lessor shall immediately notify the lessee of such overdue rent.

Article 2 (Period of Lease) The period of lease on the deposit basis shall be from November 19, 2013 to November 18, 2015.

If Article 6 (Renewal of Contract) is not desired, the lessor shall terminate the contract to the other party from six months to one month before the expiration of the lease period, and the lessee shall terminate the contract by one month before the lease period expires.
