구상금
The defendant shall pay to the plaintiff KRW 182,404,579 as well as KRW 173,986,861 as to the plaintiff. From March 6, 2015 to January 31, 2016.
1. The facts in the attached Form of the judgment on the cause of the claim (Provided, That the plaintiff and the debtor) may be recognized by comprehensively taking account of the respective entries in Gap evidence 1 through 6 and the whole purport of pleadings.
According to the above facts, the defendant is obligated to pay to the plaintiff 182,404,579 won (the amount of subrogated payment of KRW 173,986,861 plus KRW 8,417,718), and 173,986,861 out of the amount, 12% per annum from March 6, 2015 to January 31, 2016; 10% per annum from the next day to March 31, 2019; 8% per annum from the next day to the delivery date of the original copy of the instant payment order until March 18, 2020; and 12% per annum from the next day to the date of full payment.
2. Accordingly, the Plaintiff’s claim is accepted on the grounds of the conclusion.
