On October 7, 2016, the lower court upheld the first instance judgment that acquitted the Defendant on the ground that there was no proof of crime regarding the fraud of the victim C, among the facts charged in the instant case, based on its stated reasoning.

Examining the reasoning of the judgment below in light of the records, the above judgment of the court below is justifiable.

In so doing, the lower court did not err by misapprehending the legal doctrine on joint principal offenders as alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
