1. Basic facts
A. The plaintiffs are companies aimed at civil engineering and construction business. The defendant is an association established pursuant to the Framework Act on the Construction Industry for the purpose of various guarantees, loans, mutual aid business, etc. necessary for members engaged in construction business to engage in construction business.
B. The Plaintiffs and D Co., Ltd. 1) The E Co., Ltd. (hereinafter “E”)
(2) On January 3, 2017, E entered into a contract for construction work with the Plaintiffs at KRW 24,20,00,000 and KRW 24,00 on September 5, 2016 through May 31, 2018 (hereinafter “D”) with D Co., Ltd. at KRW 40,070, KRW 070,00 (including value-added tax); KRW 10,00,00,00, KRW 20,00,00, and KRW 10,000, KRW 10,000, and KRW 20,000, KRW 30,00,00 (hereinafter “instant contract”). The Plaintiffs entered into a contract with D with the Plaintiff for construction work at KRW 40,00,00,00, KRW 10,000, and KRW 30,00,00,00,00 (hereinafter “this case’s subcontract”).
