1. The Defendant’s KRW 100,432,348 as well as 5% per annum from June 16, 2015 to March 4, 2016 to the Plaintiff.
Comprehensively taking account of the overall purport of the arguments in Gap 1 through 4, it is recognized that the defendant received total of KRW 430,632,348 from the plaintiff during the period from September 16, 2010 to July 25, 2014.
Therefore, the defendant is obligated to pay to the plaintiff 100,432,348 won of the loan excluding 30,200,000 won which the plaintiff was paid to the plaintiff and 300,000,000 won which was notarized by the defendant as a promissory note, and damages for delay thereof (no evidence exists as to the period of repayment of the above loan, and damages for delay is recognized only after the day following the delivery of a copy of the complaint of this case).
