1. The Defendant shall pay to the Plaintiff KRW 22,320,840 and the interest rate of KRW 28.9% per annum from May 21, 2016 to the date of complete payment.
Comprehensively taking account of the purport of the entire arguments in the evidence Nos. 1 and 2, the Plaintiff loaned KRW 35 million to the Defendant on December 19, 2014 at 22.95% per annum (it shall be 28.9% per annum) and agreed to receive payment of KRW 48,743,128 in installments for the period from January 20 to 36, 2015, but did not receive payment from May 20, 2016, and the amount of unpaid principal was 22,320,840 won as of May 20, 2016. Thus, the Defendant is obligated to pay damages for delay at the rate of 22,320,840 won and interest rate per annum from May 21, 2016 to the date of full payment.
Therefore, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
