1. The Defendant’s KRW 126,30,000 and the Plaintiff’s annual rate of KRW 6% from March 31, 2017 to September 4, 2017, and the following.
1. Description of a claim: In addition to the description of the cause of the claim as modified, the following shall be added:
On October 25, 2016, the old Simsu Construction Co., Ltd. issued an electronic bill with face value of KRW 129,000,000 and maturity of March 31, 2017 to the Defendant.
On October 31, 2016, the Defendant rendered an endorsement on the said electronic bill to the Plaintiff.
Although the Plaintiff presented a payment proposal on the maturity of the electronic bill, the Plaintiff was refused to pay the electronic bill with an electronic document of non-payment refusal in accordance with Article 12(1) of the Issuance and Distribution of Electronic Bills Act.
(Electronic document of non-payment shall be considered as a notarial deed under Article 44(1) of the Bills of Exchange and Promissory Notes Act after confirmation by the electronic bill management agency.
