The defendant's appeal is dismissed.
The injured party's assertion of misunderstanding of facts or misapprehension of legal principles is merely a natural recovery without any particular treatment, and thus does not constitute injury as referred to in the crime of injury by robbery.
Judgment
The injury of robbery refers to the injury of the victim's completeness or physiological function.
In a case where there is extremely minor body accompanied by violence and there is no difficulty in natural therapy and daily life due to the lack of treatment, the injury of the crime of injury shall not be deemed to be the case of injury. However, this is premised on the same degree as the body of the body of the injured in daily life even if there is no assault. Thus, if the body of the injured in excess of such degree is caused by assault, it shall be deemed that the injury is caused by the assault. Determination of whether the injured in the physical or mental condition, such as age, gender, physical strength, etc. of the injured in addition to objective and uniform determination, should not be made, but shall be made based on the physical and mental detailed state, etc
(see, e.g., Supreme Court Decision 2014Do1726, Apr. 10, 2014) comprehensively taking account of the following circumstances acknowledged by the evidence duly adopted and investigated by the lower court based on the evidence duly admitted and investigated by the lower court, it is difficult to view that the injury suffered by the victim was naturally cured without the need for treatment, and does not interfere with daily life, and even if there is no assault, it is the same as the injury that may normally occur during daily life, and it is an injury that may inflict bodily integrity or disrupt physiological functions, and thus constitutes the injury of robbery.
The above conclusion is just in the judgment of the court below, and there is no error of mistake or misapprehension of the legal principles alleged by the defendant.
Valy, carrying on a very rough worship.
