1. The Defendants shall jointly and severally pay to the Plaintiff KRW 36,120,000 and the interest rate thereon from September 30, 2017 to the date of full payment.
Comprehensively taking account of the purport of the evidence Nos. 1, 2, and 3, the Plaintiff loaned KRW 60 million to Defendant B on November 29, 2016 under Defendant C’s joint and several sureties, and Defendant B discharged KRW 23.88 million out of the above loans.
According to the above facts of recognition, the Defendants are jointly and severally obligated to pay to the Plaintiff 36,120,000 won which was not repaid among the above loans and 15% interest per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from September 30, 2017 to the day of full payment, which is the day following the delivery of a copy of the complaint of this case.
The plaintiff's claim shall be accepted on the grounds of its reasoning.
