1. The defendant shall attach attached Form to the plaintiff

1. Attached Form 2 among the second floor of the building on which the list is entered;

2. Drawings 1, 2, 3, 4, 5, 6,7.

Reasons

1. Facts of recognition;

A. The Plaintiffs are co-owners of the building as indicated in the separate sheet (hereinafter “instant building”) and completed the registration of ownership transfer with respect to each/2 shares on April 25, 2017 due to sale and purchase as of April 25, 2017.

B. On April 25, 2008, Nonparty D, the owner of the instant building, entered into a real estate trust agreement with Nonparty D (hereinafter “KB real estate trust”) and “real estate security trust agreement” (hereinafter “instant trust agreement”) on the same day, and sold the instant building to the Plaintiffs through public sale.

다. 피고는 이 사건 신탁계약 체결 이후인 2014. 4. 8. D와 사이에 이 사건 건물 중 주문 제1항 기재 ㈎ 부분(이하 ‘이 사건 점포’라고 한다)에 관하여 임대차보증금 3,000만 원, 차임 월 150만 원, 임대차기간 2014. 4. 15.부터 2016. 4. 14.까지로 하는 임대차계약을 체결하고(이하 ‘이 사건 임대차계약’이라고 한다) 그 무렵부터 이 사건 변론 종결일 무렵까지 이 사건 점포를 점유하고 있다. 라.

On the other hand, the instant trust contract contains the following provisions.

Article 9 (Preservation, Management, etc. of Trusted Real Estate) (2) No truster (D, hereinafter the same shall apply) shall reduce the value of trusted real estate by means of establishing a right, such as lease, or changing the present state of trusted real estate, without the prior consent of the trustee (hereinafter the same shall apply).

Article 10 (Lease, etc.) (3) A new lease or sub-lease contract after the conclusion of this trust contract shall be concluded in the name of the truster on the condition of prior consent of the trustee, but the lease deposit shall be deposited to the trustee.
