A. Upon the Defendant’s request, the Plaintiff provided the Defendant with a total of KRW 69,843,235 (including value-added tax) up to April 12, 2018.

B. The Defendant did not pay the Plaintiff the above amount at all until now.

According to the above facts of recognition as to the cause of claim, the defendant is obligated to pay the above amount of KRW 69,843,235 as well as the interest or delay damages calculated at the rate of 6% per annum under the Commercial Act from April 13, 2018 following the day after the plaintiff supplied the last bill to July 26, 2018, and 15% per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment, as the plaintiff seeks.

3. Defendant’s assertion and judgment

A. The main point of the assertion is that the Plaintiff was supplied with goods from the Plaintiff, but rather than the date of the verbal promise, the Plaintiff could have interrupted the production of goods by late delivery, and there is a defect in the goods supplied. Therefore, the Plaintiff’s claim cannot be complied with.

B. On February 12, 2019, this Court notified the Defendant that the pleading would be concluded on the next day on the date of pleading on February 12, 2019, and ordered the Defendant to prove the assertion of defects, etc., but the Defendant was absent without proof by the next day. The sole reason was that the Plaintiff supplied the oral bid more late than the next day of pleading, thereby causing damage to the Defendant.

It is insufficient to recognize that there was a defect in the goods supplied by the plaintiff or supplied by the plaintiff, and there is no other evidence to acknowledge it.

Therefore, all of the defendant's arguments are without merit.

4. The plaintiff's claim for conclusion is justified and accepted.
