A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
(2015 large group 107) Defendant A is the representative of the "F (State) E located in Gangwon-si," and is an employer who engages in concrete structure manufacturing business by employing 12 full-time workers.
1. When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred;
Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.
Nevertheless, the above defendant is working in the above workplace from October 01, 201 to March 30, 2013.
The amount of wages, expenses, and the amount of the year-end settlement refund of retired G, including the total amount of 25,701,040 won, was not paid within 14 days from the date of retirement without agreement on the extension of the payment date between the parties concerned, as stated in the list of crimes in attached Form 2, 4, 9 (except for the case of No. 2, 4, 9).
2. When a worker retires, the employer shall pay the retirement allowance within fourteen days after the cause for such payment occurred; and
Provided, That the date of payment may be extended by an agreement between the parties in extenuating circumstances.
Nevertheless, the above defendant is working in the above workplace from March 1, 2012 to June 30, 2013.
The retirement allowance of the retired G, including 8,046,027 won, was not paid respectively within 14 days from the date of retirement without any agreement between the parties to the extension of the payment due date, as stated in the attached Form 2 List of Crimes (excluding No. 2).
