A defendant shall be punished by imprisonment for one year.
Punishment of the crime
In collusion with C and D, the Defendant intended to acquire money by borrowing money from a new apartment on the ground of 389 square meters of the land located in Nam-gu Incheon Metropolitan City E site.
Around August 5, 2003, the Defendant, along with C and D, made a false statement to the effect that “F, an employee of the said safe, “I will offer an additional apartment under construction on the said site, if I would like to offer a loan as security for the land located in Seocheon-gu E” in the territory of the Republic of Korea, Nam-gu, Incheon.
However, the Defendant, along with C, was in a state of exceeding KRW 80 million in total the construction cost and the liabilities that were not paid after the new construction work was conducted and registered under the above Eul’s name, and the above E site size of KRW 389 has already been granted a loan of KRW 180 million from the “Seoul-dong Saemaul Bank,” and the additional loan was difficult in the state of being offered as security. Therefore, even if the above site was loaned from a financial institution as security, there was no intention or ability to repay it, and there was no intention or ability to offer one apartment building constructed on the above site as security.
Accordingly, the Defendant, as seen above, was issued KRW 160 million under the name of loans from the victim by deceiving the “Yanananong 2-dong Saemaeul Community Depository,” which is the victim.
