1. The Defendant’s KRW 9,443,50 for the Plaintiff and KRW 5% per annum from June 1, 2015 to July 8, 2016.
1. The following facts may be found either in dispute between the parties or in combination with the purport of the entire pleadings in each entry in Gap evidence 2-1, 2, and Eul evidence 1 to 4:
On April 15, 2015, the Plaintiff entered into a contract with the Defendant for the construction of air conditioners, such as open shock cases, hump bags, and display stand, at the D apartment shop in Seodaemun-gu Seoul, Seodaemun-gu, Seoul (hereinafter “instant construction”). On May 27, 2015, the Plaintiff entered into an additional construction contract with the Defendant for the installation of beverage cooling, signboard, display stand, and strawbs, etc. in the said store (hereinafter “instant additional construction”).
B. After that, the Plaintiff completed both the instant construction and additional construction around May 2015, and the Defendant paid KRW 22,00,000,000 to the Plaintiff on April 15, 2015, under the name of the instant construction cost and additional construction cost, KRW 5,00,000 on June 2, 2015, KRW 7,000,000 on October 31, 2015, and KRW 22,00,000 on November 16, 2015.
