아동ㆍ청소년의성보호에관한법률위반(강제추행)

A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. 피고인은 2015. 7. 24. 00:10 전남 장성읍 영천리에 있는 장성중학교 운동장 연단에서, 피고인 여자친구의 사촌동생인 피해자 C(여, 14세)와 이야기하던 중 “5년 동안 기다리겠으니 5년 후에 나에게 와라.”라고 말하면서 갑자기 입으로 피해자의 목과 귀를 핥고, 피해자가 “20살이 될 때까지는 누구도 만지게 하고 싶지 않다.”라는 말 등을 하면서 거절하였음에도 손으로 그녀의 성기와 허벅지 등을 만져 위력으로 아동ㆍ청소년인 피해자를 추행하였다.

2. 피고인은 제1.항과 같은 날 03:00 전남 장성군 D에 있는 피해자의 아파트 계단에서, 피해자와 이야기하던 중 갑자기 입으로 피해자의 목과 귀를 핥고 손을 피해자의 바지와 속옷 속으로 넣어 성기를 만져 위력으로 아동ㆍ청소년인 피해자를 추행하였다.

Summary of Evidence

1. Any statement made by the defendant in compliance with this Act;

1. The application of Acts and subordinate statutes to statement recording records prepared by an assistant judicial police officer for a victim, which fit for such records;

1. Article 7 (5) and (3) of the Act on the Protection of Children and Juveniles against Sexual Abuse, and Article 298 of the Criminal Act, which provide for the corresponding legal provisions and the choice of punishment for the crime;

1. Of concurrent crimes, the former part of Article 37, Articles 38 (1) 2 and 50 of the Criminal Act (aggravated crime with heavy criminal facts as indicated in paragraph (2) of the same Article; a concurrent crime resulting from a violation of the Act on the Protection of Children and Juveniles against Sexual Abuse)

1. Article 53 or 55 (1) 3 of the Criminal Act for discretionary mitigation (The following extenuating circumstances among the reasons for sentencing shall be considered);

1. Article 62(1) of the Criminal Act on the suspension of execution (it is difficult to readily conclude that the Defendant has a risk of re-offending due to the lack of the history of criminal punishment, and the mother is in a production position while supporting the mother, and thus, the family and social ties relationship is clear, and the possibility of edification and the need for edification within the family and society, etc.
