A defendant shall be punished by imprisonment for not less than two years and six months.
Seized evidence subparagraph 1 shall be forfeited from the accused.
Punishment of the crime
Although the Defendant had a legal divorce around 200 with the previous wife C of the Defendant, the Defendant continued to live in the apartment house located in Geum-gu, Busan, and continuously sold the said apartment house in the amount of KRW 50 million to the Defendant’s continuous domestic violence around 2012, and then sold the said apartment house in the amount of KRW 30 million to support the two children of the sleep, and the Defendant provided the remainder of KRW 20 million to the Defendant.
However, the Defendant: (a) laid down all the above KRW 20 million and received money from the above C while having no way to identify his domicile; (b) had a deadly weapon (24 cm in total, 13 cm in length) located in the Defendant’s home, and had C and ASEAN search for the near the place of residence where both C and ASEAN live.
1. 미성년자 약취 피고인은 2013. 1. 18. 14:20경 부산 금정구 E아파트 정문 앞에서 위와 같이 과도를 소지한 채 배회하던 중 피고인의 아들인 피해자 F(남, 16세)이 그곳을 지나가는 것을 발견하고, 한손으로 피해자의 잠바 목덜미를 잡고, 다른 손으로 피해자의 손목을 잡아 꼼작 못하게 한 상태에서 G아파트 101동 앞 인적이 드문 놀이터까지 약 200미터 가량을 강제로 끌고 갔다.
Accordingly, the defendant kidnapped a minor victim.
2. On January 18, 2013, at around 14:55, the Defendant violated the Punishment of Violences, etc. Act (a collective injury with deadly weapons, etc.) threatened the said victim on several occasions, “I would like to go to go to the front of 101 G apartment 101,” but the victim continued to refuse to do so, “I would have to go to the front of the house, I would be able to go to the front of the house,” and even if the victim would not be informed of the house, I would like to not inform the victim of the house, and knee of the victim, which is a deadly weapon that was prepared in advance to go to the front of the main machine.
Thus, the defendant has a deadly weapon and the days of treatment for the victim.
