Basic Facts
On May 29, 2015, the Plaintiff transferred to C all of the tangible and intangible property, including the lease/business rights, of the Daejeon-gu, Seo-gu, Daejeon-gu, F, 5 (G points), the Seo-gu, Daejeon-gu, Daejeon-gu, H (Seoul- I refers to Daejeon- I), 7 (hereinafter “J points”), and the Daejeon-gu, Daejeon-gu, K and 3 (hereinafter “L points”), to C at KRW 80 million.
(hereinafter “instant transfer/acquisition agreement”). The Plaintiff and C entered into a quasi-loan agreement by setting the transfer price as the principal on the same day and setting the interest at 24% per annum, and N has jointly and severally guaranteed a loan obligation, and as to each of the above contracts, a notary public of the Daejeon District Prosecutors’ Office No. 3166, signed a debt repayment agreement (quasi-loan for consumption) with the document prepared by the notary public of the Daejeon District Prosecutors’ Office.
C and N are married couples.
Around July 1, 2015, the Defendant entered into a contract by C to take over the right of lease and each facility of J points as indicated below, and transferred KRW 50 million to P, a lessor of J points, on July 9, 2015 under the said contract, and transferred KRW 150 million to Q, designated by N on July 17, 2015.
In the transfer of property under Article 2, the sale price shall be KRW 400,000,000,000,000,000,000,000
