1. The Defendant’s payment order for the outstanding amount was issued against the Plaintiff at Suwon District Court Sung-nam Branch 2016 tea 8968.
On October 24, 2016, the fact that the Defendant filed a lawsuit against the Plaintiff for a claim for the payment of goods amounting to KRW 729,976 and received a payment order issued by Sungnam Branch of Suwon District Court under the Sungnam Branch of 2016 teaM8968 on December 15, 2016 is no dispute.
The plaintiff asserts that the above bonds have expired by prescription.
The extinctive prescription shall be completed, unless it is exercised for three years, for the price of goods sold by merchants.
There is no dispute over the price for the goods sold to the Plaintiff on January 5, 2007 by the Defendant, the merchant of the above claim, and it is evident that the lawsuit in this case was filed for three years thereafter.
Therefore, the above claim has expired by prescription.
The plaintiff's assertion is accepted.
The plaintiff's claim is accepted.
