2. The costs of lawsuit shall be borne by the Plaintiff.

A. On December 1, 2006, the Plaintiff entered into an insurance policy with the Defendant, an insurer, with the amount of KRW 300,000,000, the insured and the beneficiary, as the Plaintiff, and entered into an agreement on the well-being of dividends (hereinafter “instant insurance”).

B. The terms and conditions of the instant insurance concerning the amount of and cause for the payment of the general disability insurance money among the coverage of the instant insurance are as follows.

Article 17 (Insurance Money for Severe Disability) (2) In case the insured was injured by an accident as prescribed in Article 14 (Compensation for Damages) and the injury was cured, and the company has, as a direct result, lost part of the body within two years from the date of the accident, or has permanently lost its function, and there has been a subsequent disability whose payment rate as prescribed in the Disability Classification Table 1 remains less than 80%, the company shall pay to the beneficiary an amount calculated by multiplying the payment rate as determined in the Disability Classification Table by the insurance amount as stated in the insurance policy (insurance Policy) certificate.
