1. The Defendant shall pay to the Plaintiff KRW 25,00,000 and the interest rate of KRW 15% per annum from August 6, 2016 to the date of complete payment.
On September 25, 2006, the Plaintiff filed a lawsuit against the Defendant for the refund of KRW 25,00,000 for purchase price of KRW 25,000 as Suwon District Court Branch Branch 2006Da45854, and the above court rendered a judgment on December 21, 2006 that "the Defendant shall pay to the Plaintiff KRW 25,00,000,000 per annum 24% from September 25, 2006 to October 4, 206, and 20% per annum from the next day to the day of full payment," and the above judgment can be acknowledged in full view of the purport that the Plaintiff did not dispute between the parties, or that the Plaintiff shall pay damages for delay at the rate of KRW 25,00,00,00 for the interruption of the suit from September 25, 206 to the day of full payment, and according to the above acknowledged facts, the Defendant may have an obligation to pay the Plaintiff damages for delay from the next day of the suit.
The defendant asserts that since the plaintiff received a distribution in the auction procedure for the real estate owned by the defendant, the amount equivalent to this cannot be recognized. However, there is no evidence to acknowledge this.
Therefore, the plaintiff's claim is reasonable, and it is so decided as per Disposition.
