Defendant

C is a person who was sentenced to imprisonment with prison labor for a violation of the Food Sanitation Act at the Seoul Western District Court on October 25, 2013 and three years of suspended execution on November 2, 2013.

1. Defendant A is a public official belonging to the Busan Metropolitan City from January 1, 2012 to December 31, 2015, who was dispatched to the Busan Metropolitan City Food and Drug Safety Agency. Around January 1, 2016, the Defendant left his/her job to Busan Food and Drug Safety Agency and worked for the period from that time.

A. On February 3, 2012, the Defendant received a transfer of KRW 100,000 to an O account in the name of the Defendant’s use, along with a solicitation to provide convenience, such as requesting for the provision of “import declaration of food, etc.” from other companies managed by the Food and Drug Safety Agency B, a food and drug agent, at a place not known around February 3, 201.

The Defendant, including that, from around that time to January 15, 2016, received the same solicitation from 12 persons, such as B, etc. to 86 times as in attached Table 1 to Table 8, and received a remittance of KRW 1487,000,000 in total from the above O’s account.

Accordingly, the defendant accepted a bribe in relation to his duties.

On March 27, 2014, the Defendant stored three copies of the “import declaration of food, etc.” containing administrative information, such as import declaration number, import business operator’s registration number, ingredients and quality code of imported food, quality code, and import declaration processing status, at the office space of the Defendant in Busan National Drug Administration located in the Busan National Drug Administration P, which is located in 294, in the form of a Korean file, and sent them to B by e-mail.

The Defendant, including that, from around that time to September 8, 2015, shall be managed by the Food and Drug Safety Agency over 75 times, such as the part of Attached Table 9.
