Basic Facts
The Plaintiff is a local government subject to the Local Autonomy Act, and the Defendant is a press organization that publishes periodicals such as monthly ‘D’ and operates online newspaper E (E; hereinafter “instant online newspapers”).
On September 1, 2017, the Defendant posted the article of F’s title (hereinafter “instant article 1”) and the article of “G” (hereinafter “instant article 2”) in the instant online newspaper, respectively. The contents of each of the instant articles are as shown in [Attachment 3-1 and 3-2].
[Grounds for recognition] The facts without dispute. The defendant alleged the purport of the whole argument in the article 1 of this case reported to the effect that "the plaintiff was taking part in the case to H attorney-at-law, and this is related to the acceptance of an individual case by H attorney-at-law." The article 2 of this case reported to the effect that "the acceptance of 105 cases by H attorney-at-law is related to the plaintiff's adviser and was accepted by the plaintiff." The article 2 of this case reported to the effect that "the acceptance of 105 cases by H attorney-at-law was related to the plaintiff's adviser and was accepted by the plaintiff," and it did not have any truth. Thus, the article 1 of this case is obligated to post a correction report in attached Table 1 (preliminary counterargument report) and the article 2 of this case, respectively, a correction report in attached Table 2 (preliminary report).
[Dissenting Opinion] The fact that the content of the number report (1) should be examined and examined in relation to H attorney-at-law is the suspicion of acceptance of the case during the period.
