A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. A person who intends to conduct motor vehicle transaction business in violation of the Motor Vehicle Management Act shall register with the head of a Si/Gun/Gu, as prescribed by Ordinance of the Ministry of Land
Around November 13, 2018, the Defendant, without registering a motor vehicle transaction business, provided guidance to C to purchase a motor vehicle in Seo-gu Incheon Seo-gu Special Metropolitan City B motor vehicle transaction complex, and provided a motor vehicle transaction business by entering into a sales contract of KRW 3,864,00 for the said motor vehicle and providing good offices for the purchase of a motor vehicle.
2. On November 12, 2018, the Defendant forged an official document with a view to forging a motor vehicle registration certificate in order to receive telephone calls for vehicle purchase and to prevent C from entering into a sales contract and from cancelling the contract if C entered into a sales contract.
On November 12, 2018, the Defendant entered the registration certificate form file in the name of the head of Seo-gu Incheon Metropolitan City and affixed the official seal of the head of Seo-gu, Incheon Metropolitan City with the seal of the head of Seo-gu, Incheon Metropolitan City through Internet search, as “non-guarantee” in the column for use using the picture board program. Under the right side column, the Defendant prepared a form stating “within three years”, “in the e-mail and was kept in the e-mail,” “D, in the vehicle registration number column using mobile phones at the time and place as indicated in paragraph (1),” written “E, in the owner’s name column,” and “C” written at his own discretion and printed out, respectively.
Accordingly, for the purpose of exercising, the defendant has forged the registration certificate in the name of the head of Seo-gu Incheon Metropolitan City, which is a public document.
3. The Defendant has completed the registration certificate in the name column of the owner in the name of the head of Seo-gu Incheon Metropolitan City, which is a forged official document, with C at the time and place specified in paragraph 1, as described in paragraph 2.
