A. The Defendant is an educational foundation that operates the EF hospital (hereinafter “Defendant hospital”), and the Plaintiffs are the employees of the Defendant hospital.

B. The Defendant paid wages to workers in accordance with the organization agreement, regulations on remuneration for employees with stock certificates, etc. The Defendant’s wage-related provisions relating to the instant case are as follows.

Article 34 (Annual Paid Leave) (9) of the 2015 Organization Convention, upon the amendment of this Article, medical personnel shall, with respect to any member who is in office as of February 28, 2012, determine a compensation allowance in accordance with the following formula and pay it to the employee in installments for 12 months:

Provided, That the amended provisions of this Article shall apply from March 1, 2012, and the private persons who entered after March 1, 2012 shall not be eligible for compensation allowances.

The relevant compensation allowances shall be excluded from ordinary wages.

Compensation allowances (the number of days of each individual's monthly rent from March 1, 2011 to February 28, 2012 as of March 1, 2012 - the number of days of each individual's annual leave calculated on March 1, 2012) ¡¿ (the number of days of each individual's annual leave calculated on March 1, 2012) x 1/30 of the monthly ordinary wage as of December 2011, the ordinary wage of members of Article 40 (ordinary wage) is basic pay, assignment allowances, technical allowances, technical allowances, household subsidies, work allowances, accounting allowances, traffic expenses, and bonuses (100%).

§ 45. (Fins and Fins and Finsent Fins) (1) Bonuses shall be paid 450% (2, 3, 4, 6, 7, 8, 10, 11, 12 December) of the basic monthly salary each year.

(2) The cost of physical training shall be 50% of the basic salary in May each year.

Article 48 (Calculation of Wages below Monthly) The calculation of wages below Monthly shall be made on a daily basis.

(Provided, That in the case of death, the full amount for one month shall be paid even if it is less than one month).

Article 34 (Annual Paid Leave) (9) of the 2017 Organization Convention (hereinafter referred to as the 2017 Organization Convention) with respect to any member who is in office on February 28, 2012 as of February 28, 2012, a compensation allowance shall be determined according to the following formula and payable to the member who is in office in installments for 12 months:

Provided, That the amended provisions of this Article shall apply from March 1, 2012, and on March 1, 2012.
