1. The Defendants jointly share KRW 40,471,00 with the Plaintiff and KRW 5% per annum from September 4, 2015 to March 22, 2017.
1. Facts of recognition;
A. The Plaintiff is the managing body of the White Dried Dried Dried Dried Dried (hereinafter “instant bridge”) in Jung-gu, Incheon, and the Defendant trucking Services Federation is a mutual aid contractor who has entered into a mutual aid agreement with the Co., Ltd. (hereinafter “Sable Cors”) on its cargo vehicles.
The Defendant Incheon Metropolitan City Corporation and the Korea Land and Housing Corporation agreed on April 30, 2015 (hereinafter referred to as the “instant agreement”) to undertake the work of repairing and maintaining the defects of the instant road as of April 30, 2015, by building and managing the Yeongdeungpo-gu Incheon Metropolitan City (hereinafter referred to as the “instant road”) pursuant to the Incheon Free Economic Zone Young City Development Project (hereinafter referred to as the “Development Project”). The Defendant Incheon Metropolitan City signed an agreement on April 30, 2015 (hereinafter referred to as the “instant agreement”) with the Defendant Incheon Metropolitan City Administration and the Korea Land and Housing Corporation to take charge of the work of repairing and maintaining the defects of the instant road by December 31, 2015.
On June 1, 2015, the Director of the Incheon Free Economic Zone Authority published the completion date of the development project of this case including the road of this case on December 20, 2013 (No. 2015-126 of the Incheon Metropolitan City Public Notice of Free Economic Zone Authority) on December 20, 2013.
According to the above notice, the general project operator of the development project of this case is defendant Incheon Metropolitan City, defendant Korea Land and Housing Corporation, Incheon Urban Corporation, and 512 of the route including the road of this case was designated as the portion to which the State (local government) reverts.
B. (i) On September 4, 2015, A belonging to Prichip shall drive a Prichip Track Cargo Vehicles (B; hereinafter “instant Cargo Vehicles”) loaded with Bakhoe, a construction equipment, around 08:00 on September 4, 2015.
