On May 3, 2012, the Defendant stated that “If he/she loans to the ice of an entertainment tavern running in a gold club, he/she will pay interest of KRW 1 million per month and pay it within one year, and if he/she fails to pay it according to his/her promise, he/she will transfer the entertainment tavern operated by him/her within one year” to the victim B at the coffee shop located in the Young-gu, Suwon-gu, Suwon-gu, Suwon-gu, Suwon-si, Suwon-gu, Suwon-si, and received KRW 30 million from the victim’s check on the face, and around July 25, 2012, the Defendant received money from the victim E at the D coffee shop located in the Suwon-gu, Suwon-gu, Suwon-gu, Suwon-gu, Suwon-gu, Suwon-si, and there is no problem that he/she has repaid the money with two apartment houses.” If he/she fails to pay it, he/she would transfer it to the Defendant’s account.”

However, at the time of borrowing money from the victims, the Defendant had a total of 78 billion won, including loans from Hyundai Capital Co., Ltd. 30 million won, bonds companies, and other loan 188 million won, loans from Suwon Saemaul Bank 40 million won, loan 180 million won, and deposit 180 million won. The property exceeded the debt due to an apartment of 150 million won, and an apartment of 150 million won, and 50 million won. Despite the fact that the amount of loan 35 million won per month is equal to the monthly income, the Defendant did not have any intent or ability to repay the loan from the victims, even if it borrowed money from the victims, as the monthly income is more than the income paid with the rent of 5.8 million won.

Nevertheless, the Defendant received a total of 60 million won from the victims as above, and acquired it by fraud.
