[Judgment of the court below]

1. Fraud;

A. Around April 2009, the Defendant made a false statement with regard to the victim C, stating that “The victim C would be able to be able to become a street store in the vicinity of Mapo-gu Seoul Mapo-gu Seoul Metropolitan Government.”

However, even if the defendant received money from the victim under the pretext of the old-standing recipient, he was only willing to use the above money for gambling or living expenses, and he did not have an intention or ability to prepare a job for the victim.

Nevertheless, on April 3, 2009, the Defendant, by deceiving the victim, received 6 million won from the victim to the agricultural bank account under the name of the Defendant from the victim, and received 6 million won from that time until July 24, 2009, from that time, the Defendant received 42,047,00 won in total over 11 times, as shown in the attached crime list (1) and received 12,250,000 won among them, and did not repay the remaining 29,797,000 won and did not repay the remainder of 29,797,000 won.

B. Around August 5, 2009, the criminal defendant against the victim F made a false statement to the victim F, stating, “The victim F was holding a lot of oly occupation at a store in Gangnam-gu Seoul, and there is a difference between the victim F’s price and the victim’s price so that he/she can work for the street in the vicinity of the Eth unit.”

However, even if the defendant received money from the victim under the pretext of the old-standing recipient, he was only willing to use the above money for gambling or living expenses, and he did not have an intention or ability to prepare a job for the victim.

Nevertheless, the Defendant, by deceiving the victim as such, received KRW 1 million from the victim to the Agricultural Cooperative Account under the name of the Defendant on the same day, and thereafter received KRW 5,0710,000 from that time until November 6, 2009, in total 32 times, as shown in the attached List of Crimes (2).

C. The Defendant against the victim G is at the victim G’s house located at H around June 19, 201.
