The prosecution of this case is dismissed.

Reasons

1. On July 3, 2015, around 20:30 on July 3, 2015, the Defendant assaulted the victim’s neck on one hand on the ground that the victim D (57 tax) expressed his desire to do so to the Defendant in front of the 102 East-dong, Seoul Special Metropolitan City, Nowon-gu apartment house 102.

2. Determination

(a) Crimes of non-violation of intention (Article 260 (3) of the Criminal Act);

B. Withdrawal of wishing to punish the victim after the indictment of this case

C. Judgment dismissing public prosecution (Article 327 subparag. 6 of the Criminal Procedure Act)
