A. The Plaintiff is a company running the insurance business. On June 24, 2005, the Defendant concluded a non-distribution agreement insurance contract (the long-term damage insurance, hereinafter “instant insurance contract”) with the Plaintiff as of June 24, 2004 with the insurance period fixed by June 24, 2004.
Among the terms and conditions of the instant insurance contract, the contents relating to the terms and conditions of the instant special contract for diagnosis expenses for the Hemical diseases (hereinafter “the instant special terms and conditions”) are as follows.
16-1 Terms and Conditions of Special for Expenses for Diagnosis of Hemical Diseases
1. (Compensation for Loss) If the insured as stated in the insurance policy becomes final and conclusive as the first bruent disease during the insurance period of this Special Terms and Conditions stated in the insurance policy (hereinafter referred to as the “insurance period”), the company shall be bound to compensate for it in accordance with this Policy.
The term so-called Hudovascular disease refers to the so-called Madovascular disease that has been infected or has been caused to the insured from the time when the company's responsibility began under this contract.
Provided, That no compensation shall be made if the insured knew of the infection or outbreak before the commencement of liability.

The diagnosis and confirmation of a Hemovascular disease shall be conducted by a person with a doctor's license (excluding dentists) of a domestic hospital as provided for in Article 3 of the Medical Service Act or a foreign medical institution abroad recognized by the company as equivalent thereto, and this diagnosis shall be based on the heart, heart, ultraspathy, ornamental crym, ornamental cryming, and cardiopulmonary zymology test of blood together with medical history.
