1. Basic facts

A. The Plaintiff A and the Selection (hereinafter collectively referred to as the Plaintiff et al.) are part of the co-owners of the instant land, among the co-owners of the instant land, who are part of the apartment units with a total of 48 households AK apartment units on the ground of 4120 square meters (hereinafter referred to as the “instant land”).

B. The defendant is a person who operates a gas station outside the above apartment wall.

피고는 이 사건 토지 중 담장 밖에 있는 별지도면 표시 ㅂ, ㄴ², ㄷ², ㄹ², ㅊ, ㅈ, ㅇ, ㅅ, ㅂ의 각점을 순차로 연결한 선내 (나)부분에 주유소 건물 60㎡를, ㄹ², ㅂ², ㅅ², ㅌ, ㅋ, ㅊ, ㄹ²의 각 점을 순차로 연결한 선내 (라)부분에 주유소차고 75㎡를 건축하여 위 각 부분 토지를 점유하고 있다.

또한 피고는 별지도면 표시 ㄷ², ㅁ², ㅂ², ㄹ², ㄷ²의 각 점을 순차로 연결한 선내 (다)부분 54㎡를 주유소 부지로 사용하며 점유하고 있다.
