The prosecutor's appeal is dismissed.
1. The summary of the grounds for appeal is as follows: (a) in light of the financial status of the defendant at the time of the crime of this case, the court below acquitted the defendant of the facts charged of this case, even though the defendant was unaware of the victim by deceiving the victim of goods and money, although the defendant did not have

The lower court determined as follows based on the evidence duly adopted and examined: (i) the Defendant settled some of the checks issued for payment in direct transactions with the victim; (ii) the Defendant borrowed money at a discount rate around July 2013 and around August 2013; (iii) the Defendant borrowed money from the Defendant’s bank account until December 31, 2013; and (iv) the Defendant borrowed money from the Defendant’s bank account to the Defendant’s financial position as to the Defendant’s non-payment of the checks; and (v) the Defendant borrowed money from the Defendant’s bank account as to the Defendant’s non-payment of the checks until December 31, 2013.
