1. The Defendant shall pay to the Plaintiff KRW 9,500,000 and the interest rate of KRW 15% per annum from August 4, 2016 to the date of full payment.
According to the records, the Plaintiff lent KRW 10 million to the Defendant on June 9, 2014, and the Defendant did not answer the Defendant’s claim against the assertion that only the Defendant paid KRW 500,000 among them. Thus, the Defendant is obligated to pay to the Plaintiff delay damages at the rate of KRW 15% per annum as prescribed by the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from August 4, 2016 to the date of repayment, on which the Plaintiff’s original copy of the instant payment order, stating that the Plaintiff sought a loan against the Defendant, was served on the Plaintiff.
Thus, the plaintiff's claim of this case is accepted on the ground of the reasons.
