1. The Defendant’s KRW 34,500,000 as well as its annual 6% from November 15, 2018 to August 10, 2020 to the Plaintiff.
The cause of the instant claim is as shown in the attached Form, and it can be recognized by integrating the facts not disputed between the parties and the evidence A 1 through 3.
Therefore, the Defendant is obligated to pay to the Plaintiff the construction cost of KRW 34,50,000 as well as damages for delay calculated at the rate of 6% per annum under the Commercial Act from November 15, 2018 to August 10, 2020, which is the delivery date of a copy of a complaint, and 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, from the next day until the full payment is made.
Therefore, the plaintiff's claim is justified and accepted.
