B는 2019. 7. 16. 09:30 무렵 C와 D가 머물고 있는 춘천시 J 호텔 앞으로 G, H, I을 집결시킨 후 “내가 사귀는 여자친구가 있는데 지금 바람이 나서 D라는 남자와 함께 도망간 상태이고, 여자친구가 내 돈을 많이 가지고 있기 때문에 반드시 잡아야 한다, 너네들이 좀 도와달라”고 부탁하고, “D가 나오면 도망가지 못하게 너네가 뛰어가서 양쪽에서 붙잡고, D를 주차장 쪽으로 데리고 와라, 여자애는 내가 잡겠다”, “I은 미성년자로 소년부 재판을 받으면 길어야 1년 형을 받을 테니 D에게는 ‘동생(I)이 너(D)를 죽도록 팰 수 있다’고 겁을 주겠다, 무조건 잡아야 한다”고 말하여 C와 D를 잡기 위한 구체적인 계획 및 역할분담에 대해 상호 공모하였다.
