1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. On April 6, 2015, the Plaintiff was subcontracted to KRW 133,700,000 for construction cost among the new construction works for multi-household B in king-si, the Defendant subcontracted to KRW 133,700,00.
2. The parties' assertion
A. Since the scope of the Plaintiff’s alleged construction work was 31 square meters per original floor and 42 square meters increased to 77 square meters, the Defendant should pay KRW 38,500,000 to the Plaintiff additional construction cost due to the increase in the construction area.
B. After the completion of the Defendant’s assertion construction, the Defendant settled the accounts and paid all the construction cost.
3. The Plaintiff and the Defendant agreed to make a final settlement agreement on September 14, 2015 with respect to the said construction work, and agreed to make the total construction cost of KRW 148,700,000 increased by KRW 15 million from the original construction cost, and the Defendant paid the increased amount to the Plaintiff in full (Article 2-1,3, and the purport of the entire pleadings). The Plaintiff’s claim is dismissed on the grounds that there are no justifiable grounds.
