1. The defendant shall pay 155,250,000 won to the plaintiff and 150,000,000 won from January 6, 2020 to February 4, 2020.
Comprehensively taking account of the overall purport of the pleadings, evidence Nos. 1 through 3, the Defendant borrowed KRW 150 million from C from November 5, 2018 to November 5, 2018, and KRW 1250,000 per month (interest rate of KRW 100,000 per annum). The Defendant did not pay interest to C until January 5, 2020; the Plaintiff acquired the above loan claim from C on January 9, 2020; and the Plaintiff transferred the credit assignment notice attached to the written application for the instant payment order to the Defendant on February 4, 2020.
According to the above facts, the defendant is obligated to pay to the plaintiff 155,250,000 won (i.e., the principal amount of KRW 150,50,000,000) and interest of KRW 150,000,00 of which principal amount is paid, 100,000 per annum from January 6, 2020 to February 4, 2020, which is the delivery date of the application for the payment order of this case, and interest of KRW 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from the next day to the full payment date.
Therefore, the plaintiff's claim of this case shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
