Defendant M is a person with no certain occupation, and Defendant M is a high school-friendly A (the Jeju District Court sentenced to six months of imprisonment for fraud in April 4, 2019 and appealed in the appellate trial proceeding pending in the appellate trial trial) and Jeju Youth, and conspired to acquire money by receiving money from the Defendant’s account, by posting a letter suggesting that E-game money will be sold on the Internet bulletin board, while living together at high school-friendly A (the Jeju District Court sentenced the Defendant to six months of imprisonment for fraud) and Jeju Youth.

Accordingly, at around May 4, 2018, the Defendant sent a letter to “E” online game through a computer, and then posted it to the victim N, who reported the fact that “If deposited money, he will send the E Game money at the current market price,” and sent it to an account under the name of the Defendant under the name of the Defendant.

However, the Defendant and A did not have the E-game money at the time, and even if they received money from the victim, they did not have the intent or ability to send the E-Game money to the victim.

Nevertheless, as seen above, the Defendant: (a) deceiving the victim as above; (b) received KRW 400,000 from the victim to the Defendant’s account under the name of the Defendant; and (c) had no intent or ability to sell game money on a total of six occasions from around that time to June 18, 2018; (b) deceiving the victims as indicated in the separate list of crimes; and (c) received KRW 1,291,000 from the victims to the financial account in the name of M.

Accordingly, the Defendant conspired with the victims and received KRW 1,291,00 in total under the pretext of sales proceeds of game money in collusion with the victims as above.

Defendant A, "2019 order765", shall be punished by imprisonment with prison labor at the Jeju District Court on December 13, 2018.
