The prosecution of this case is dismissed.
Reasons
1. 공소사실의 요지 피고인은 2020. 6. 5. 17:20경 전북 완주군 B에 있는 C 편의점에서 피해자 D(남, 7세)이 자신의 아들을 따돌린다는 이유로 피해자에게 “왜 사람 병신 만드냐, 차로 깔아뭉갠다, 니네 집에 칼 들고 쫓아간다.”라고 하면서 오른손 주먹으로 피해자의 머리와 어깨를 각 1회씩 때려 폭행하였다.

(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;
(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.
C. The victim's petition for non-prosecution to punish the defendant after the prosecution of this case was filed with the intent of not wanting to punish the defendant
(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
