A. The Plaintiff received the instant construction contract from the Defendant, Kim Jong-si, Kimpo-si, and one parcel of land (hereinafter “instant building”) (hereinafter “instant construction”) by determining that construction cost of KRW 500,000,000 per week is paid at KRW 50,000 per week, and the Plaintiff and the Defendant drafted the instant construction contract form on June 8, 2016.

B. The special terms and conditions of the instant construction contract are as follows.

1. Main Corporation;

a. Floor engineering works;

c. Panel Corporation - Walls 150t, color - roof 225t, color

2. External works;

a. All of the official works in the septic tank site/one place (three places) and the mentmen joints;

4. Basic civil engineering works;

a. Site creation and axis (Reinforcement), mentmen and pipes, road works, separate construction (general 15 million won) * Cleanup tank consultation with design office * 545,00,000,000 won per week out of total construction cost * 500,000,000 won per week transfer (cash 40,000 won).

C. Around December 2015, the Plaintiff carried out the flatization work of the instant construction site, and implemented the road, drainage, packing, and reinforced soil retaining wall construction.

In addition, after the instant construction contract changes in the use of some buildings, one septic tank was additionally constructed, and the roof panel was constructed by 225T-260T.

As the instant construction cost, the Defendant paid the Plaintiff KRW 50,00,000 on May 20, 2016, KRW 100,000 on June 2, 2016, KRW 100,000,000 on June 2, 2016, KRW 150,000 on June 15, 2016, KRW 100,000 on July 20, 2016, KRW 150,000 on August 22, 2016, KRW 50,000 on October 18, 2016, and KRW 50,000 on aggregate.

E. At the time of completion of the instant construction project, the Defendant prepared an agreement on the payment of the remainder of the construction cost (hereinafter “instant agreement”) stating that the Plaintiff shall pay the remainder of KRW 40,000 to the Plaintiff within 15 days after completion of the construction work.

F. The instant building was approved on February 24, 2017.
