1. The defendant shall be punished by imprisonment for a year and two months, and a fine of seven thousand won; and
2. The above fine shall not be paid by the defendant.
Punishment of the crime
On May 18, 2012, the Defendant was sentenced to one year of imprisonment for fraud at the Busan District Court, and the execution of the sentence was completed on February 18, 2013 at the Busan Correctional Institution.

1. On June 30, 2013, around 19:30 on June 30, 2013, the Defendant: (a) called the victim D’s fraud on a taxi operated by the victim D in front of the Busan Regional Military Manpower Office located in Suwon-dong, Busan Regional Military Manpower Office; and (b) when the Defendant entered into a destination near the destination, the Defendant made a false statement to the effect that “If the Defendant borrowed KRW 20,000,000 in cash, he would transfer KRW 35,00,000 as taxi fee to a telebank, if he did not cause any key to the taxi, and then transferred KRW 55,00,000 to a telebank.” (c) On the other hand, the Defendant was committed as if he transferred KRW 55,00 by using telebanks.
However, the Defendant did not transfer the above money.
The Defendant received 20,000 won from the victim, i.e., 20,00 won from the seat, and exempted the payment of 35,000 won from the taxi charges, and acquired property or pecuniary benefits equivalent to 5,000 won in total.
2. Fraud to victims E;
A. On September 1, 2013, at around 01:10 on September 1, 2013, the Defendant: (a) stated that he was boarding the F taxi operated by the victim E in the vicinity of the Seongbuk-gu Jeju Jeju Jeju Jeju Jeju Jeju Jeju Jeju Jeju Jeju Jeju Jeju District and said that he would go to the Women’s Welfare Center located in the Seocho-dong, Geumcheon-gu, Geumcheon-gu, Geumcheon-gu, Seoul; (b) stated that “A and the keys have been left to the company. Then, the Defendant would transfer the taxi fee of KRW 30,240 to the account.”
However, there was no cash held by the defendant, and there was no intention or ability to remit the above amount to the victim because there was no balance in his own account.
The Defendant exempted the victim from paying 30,240 won a taxi fee from the seat, and acquired pecuniary benefits equivalent to the same amount.
