Dismissal portion: Partial dismissal of a part of the amount exceeding the amount calculated by applying the rate of 15% per annum, which is the interest rate under the provisions of the Act after October 1, 2015, the enforcement date of the provisions on statutory interest rates under the main sentence of Article 3 (1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 26553, Sept. 25, 2015; hereinafter “the provisions”), among damages for delay claimed by the Plaintiff, at the rate of interest rate under the previous provisions until September 30, 2015 (see, e.g., the interest rate under the amended provisions of this Decree with respect to cases where the first instance trial is pending at the court as at the enforcement date of this Decree under Article 2 (2) of the Addenda of the Act, and the interest rate under the amended provisions of this Decree, from October 1, 2015).
