1. 피고인들의 공동범행 피고인들은 2014. 9. 13. 02:30경부터 같은 날 03:00경까지 의정부시 E 소재 피해자 F 운영의 ‘G’ 주점 앞 야외테이블에서 술을 마시다가 플라스틱 테이블을 수회 뒤집어엎고 옆 테이블에 맥주컵을 집어던져 깨뜨린 후 종업원 H을 불러, 피고인 B은 “야, 이 새끼 기분 나쁜가봐, 내가 누구인지 알아 장사하기 싫어 ”라며 소리치고, 피고인 A은 “야, 이 새끼야, 너 내가 누구인지 알아 ”라고 하며 플라스틱 테이블 위를 주먹으로 수회 내려치고 맥주잔을 집어 들고 위 H을 향해 던지는 시늉을 하는 등 소란을 피워 손님들을 그곳에서 나가게 하였다.

2. 피고인 A 피고인은 위 제1항 기재 일시, 장소에서, 위와 같이 소란을 피워 112신고를 받고 출동한 의정부경찰서 I파출소 소속 경찰관인 J(26세), K(32세)이 술값을 지불하고 귀가하도록 요청하였다는 이유로 위 주점 업주 F, 종업원 H, 성명불상의 손님들과 행인들이 있는 가운데 위 J, K에게 “이 씹할 놈들아, 이 씹할 새끼야, 개새끼들아, 뭐야 너는 뒤질라고, 이 씹할 놈들아”라고 큰 소리로 말한 후 손바닥으로 위 J의 가슴 부위를 강하게 밀치고 주먹으로 배 부위를 수회 툭툭 친 다음 손날로 목 부위를 치는 시늉을 하다가 “야, 이 새끼 때리면 안되지, 내가 처벌받으니깐”이라고 하는 등 폭행하였다.
